1. Who we are

novasite.co.za is owned and operated by Nova Site ("we", "us" or "our"), a web design studio in Pretoria, Gauteng, South Africa. You can reach us at info@novasite.co.za, +27 75 947 9549 or through our contact page. By using this website you agree to these terms and to our Privacy policy. If you do not agree, please do not use the site.

2. Our services, quotes and prices

The information on this site describes our services in general terms. It is not an offer that you can accept to form a contract. Before we start any work, we send you a written, itemised quote. The quote, together with any written agreement we sign with you, sets out the scope, price, payment terms and timelines, and takes precedence over anything on this website.

Quotes are valid for the period stated on them. Prices, packages and promotions mentioned anywhere on this site or in our messages may change until they are confirmed in a quote you have accepted.

3. Portfolio, demos and reviews

• Client names, logos, trademarks and content shown on our Work page belong to those clients. If you are a client and would like your project removed or changed, email us and we will do it promptly.
• Demo and client websites hosted on novasite.co.za subdomains belong to their owners, have their own terms and privacy policies, and may change or be removed at any time.
• Reviews are quoted exactly as our clients wrote them, mostly on Google, and remain the views of their authors.
• Results we describe for past projects depend on each business and are not a guarantee of the results you will get.

4. Using this website

You agree not to:

• use the site for anything unlawful, or send spam, malicious code or false information through our contact form;
• try to hack, disrupt or overload the site, or gain unauthorised access to it, our admin systems or the servers it runs on;
• scrape, copy or mirror the site or its content in bulk;
• frame the site, or present it or our work as your own.

5. Intellectual property

The Nova Site name and logo, and the design, text, photos, graphics and code of this website, belong to Nova Site or are used under licence, and are protected by copyright and other laws. You may view and share links to the site, and print or save pages for your own reference. Anything else, including copying our text or design for another website, needs our written permission. Ownership of work we create for clients is set out in each client's quote or agreement.

6. Messages you send us

When you send us a message, you confirm that the information is accurate and that you are allowed to share it. We use it as described in our Privacy policy. Sending a message does not create a contract or oblige either of us to go ahead with a project.

7. Links to other websites

This site links to client websites, WhatsApp, LinkedIn, Google Maps and other services. We do not control those websites and are not responsible for their content, availability or how they handle your information.

8. No warranties

We work to keep this website accurate and available, but it is provided "as is". To the fullest extent allowed by law, we make no promises that it will always be available, error-free or free of viruses, or that its content is complete or up to date. Information on the site, including our articles and guides, is general information and not professional advice for your specific situation.

9. Limitation of liability

To the fullest extent allowed by law, Nova Site and its owners and team are not liable for any loss or damage, whether direct, indirect or consequential, arising from your use of, or inability to use, this website or from relying on its content. Our responsibility for client work is governed by the relevant quote or agreement.

Nothing in these terms limits any right you have, or any liability we have, that cannot be limited by law, including under the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002 where they apply.

10. Indemnity

You agree to indemnify Nova Site against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of this website.

11. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. If you keep using the site after a change, you accept the updated terms. Changes never alter a quote or agreement you have already accepted.

12. Governing law

These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction over any dispute about them. This does not take away any rights you have under the consumer laws of the country you live in.

13. General

If any part of these terms is found to be invalid, the rest remains in force. If we do not enforce a right straight away, we have not given it up.
